After brief recess, Baez asks to approach and parties go to sidebar with Judge Perry.
Juror #3268 is called in. She was out of country part of the time during case. Recalls seeing timeline on Bay News 9 online. She recalls there was a gap in child going missing and being reported missing; thinks there may have been another person of interest at one point. Her mom told her about case couple of weeks ago, but just said child was missing and mother suspected.
Drane-Burdick for the state. Juror was a yacht stewardess and was working out of the country much of 2008 til late 2010. Recalls transcript of parents and Anthony talking wherein Anthony seemed more concerned about herself than child. Saw photos of Caylee, Casey. She hasn't read any blogs, though.
Juror read utility worker tried to alert LE a couple of times and that he was considered person of interest (may have been her own inference, she says). Recalls George trying to take his life. Apparently, she looked at this info just this past Monday. She was here Wed the week prior and thought by Monday she wasn't going to be chosen.
Baez for defense. Juror says she is unbiased, didn't form a conclusion based on what she'd read.
Judge begins death penalty voir dire. Juror says she would not be able to judge Anthony fairly if she didn't testify; that she'd want to hear from her. She is excused.
Juror #4046 is next. Juror recalls a child was missing and a babysitter was involved. From that point on, doesn't recall anything until her husband mentioned a potential juror was also a potential witness. Then she recalls seeing picture of Anthony in a nightclub. Has not formed an opinion of Anthony's innocence or guilt.
Juror says she does not find events like what happened to this child entertainment and does not find it entertaining to talk about. All she hoped was for the child to be found alive. Not something she likes to talk about; makes her very sad. Says she can judge just on facts and evidence; would not hold it against Anthony if she didn't testify.
Ashton for state. Juror moved to SC, then back to FL, back to SC...and back to FL again. Been back in FL since July 2010. She can't recall when in 2008 they moved to SC, but she recalls it was after Caylee went missing. Doesn't watch much local news; would've seen it on whatever happened to be on at the time. Juror has never watched the cable shows Ashton mentions. She is not much of a social media type person (no Twitter, etc.).
Judge Perry instructs on and questions about DP now.
Uh-oh! In the midst of his instruction, someone in the audience has an outburst and is immediately escorted out. Defense moves to dismiss potential juror because the "outrageous outburst" happened in front of that juror. What did the shoeless (carrying her sandals) woman scream? "She killed someone anyway!"
So much for a drama-less day!
Judge calls a brief recess. Judge bringing woman who had outburst before the bench. Guessing he will make clear to anyone else with similar ideas that it will NOT be tolerated.
Judge held the woman in contempt and sentenced to two days in county jail (I will get the details up during lunch recess). AND he excused the juror who heard the outburst.
Juror #4013 now. Kept up with the case via news up until the arrest, she says. Saw George and Cindy wearing the Caylee shirts. Heard others discuss case and express opinions of guilt. She herself has not formed opinion. "I'm not really one to judge people." Says she can set aside what she's seen/heard and judge solely on law and evidence.
George for the state. Watched Nancy Grace during that time period. Said she saw protesters outside home; the bounty hunter. She hoped the mother didn't do it. Once she knew the baby was gone, didn't keep up with it much.
Baez for defense. Asks juror if she views Nancy Grace as news or sort of like wrestling. Juror says it can be ridiculous at times, doesn't take it too seriously. When Baez asks if that coverage will influence her, the juror says she guesses it wouldn't.
Judge Perry goes into the DP voir dire now. Juror has never thought about death penalty; no objections to it, though. Juror can vote for DP if warranted and LWOP if that's warranted. No questions from the state.
Finnell whips out the cart and horse again. Juror has no religious/political affiliation with orgs that take position on DP; can follow judge's instructions and law.
George with general voir dire for state. Juror is a widow. Husband was in prison for drugs. He was out one year before he died, but they were apart years before that. Juror was herself accused of a crime (bounced checks). They all go to sidebar to discuss this off-mic.
Back on the record. Juror raised her son on her own with some help from her parents. Can operate a computer proficiently. Has a dog, a black lab. Baez has no questions.
Neither side challenges the juror. Juror #4013 becomes the 18th retained juror. Lunch recess til 1:10 pm.
